Secure Contracts (Wales) and the Mental Capacity Act 2005

If you have issued new Secure Contracts following the introduction of the Renting Homes (Wales) Act 2016, it is important that the former tenancy agreement was valid to begin with.


We have identified the following circumstances where the previous Welsh tenancy agreement itself was not valid, this includes:

  • Unsigned 'Tenancy Agreements'

  • The person signing the tenancy did not have the mental capacity to sign

  • The person signing was someone with no official authority to sign.

We have also identified concerns with unlawful termination of former tenancy agreements by professionals.
