DoLS – failing to assess people in hospital for standard DoLS authorisations

A Local Authority has recently been found at fault for its policy of not assessing people for standard DoLS authorisations who are hospital despite the hospital completing an Urgent DoLS authorisation. The Ombudsman stated: Within one month of my final decision, the Council will:

  • Review and amend the policy of not completing DOLS standard authorisations while a person is in hospital

  • Apologise and make Mr X a symbolic payment of £250 for the avoidable distress and time and trouble.’
