Mental Capacity Act – review and reform

The Secretary of State for Health, Wes Streeting has committed to reforming the Mental Capacity Act after ITV News highlighted multiple cases of vulnerable adults not getting assessments of mental capacity leading to potential risks and harm to those individuals. The minister stated: ‘So we are looking at this actively, we're determined to take action. That will include a review of, and ultimately reform of, the Mental Capacity Act.’

It would appear a key element of reform would be to introduce a legal right for families/carers to request an assessment of mental capacity to be carried out by a local authority, NHS Trust or ICB in relation to decisions around care and/or treatment.
