Inspecting the Mental Capacity Act - moving beyond the tick box



On 8 July 2022, the CQC rated Trinity House Care Centre inadequate (special measures). It is a care home for up to 35 people. The inspection report highlights a number of issues including the need to record assessments of mental capacity adequately: ‘Where people lacked capacity to make particular decisions, the provider had not assessed their mental capacity or recorded best-interests decision-making in line with the MCA. For example, one person's mental capacity assessment had resulted in them being assessed as 'lacking capacity'. The assessment lacked sufficient detail to evidence the decision-making process leading to this conclusion and was not decision specific.’ Download the report from here.
