Community Treatment Orders (CTO) and the Mental Capacity Act The Court of Protection has recently published an interesting example of the interface between the Mental Health Act and the Mental Capacity Act. It relates to a 36 year old woman under a Community Treatment Order who lacks mental capacity to a range of decisions including contact with her mother. CTOs have very limited powers and do not cover contact issues. The judgment shows how the Mental Capacity Act can work alongside the MHA to enable an effective care package for someone in the community. The judgment can be downloaded here
