The right to visit people in care homes

On 8th December 2021, the Competition and Markets Authority issued updated guidance on consumer law relating to care homes. In relation to care home visits it states: ‘Residents must be allowed to see their family and friends if they want to and you must ensure that there are suitable opportunities to see visitors. The right to have visitors is underpinned by legislation and if you impose an unreasonable restriction on a resident’s right to have visits from family or friends, you are also likely to infringe consumer law.’
