Mental Capacity Act failings at a mental health NHS Trust

A recent inspection report from the CQC covering nine mental health wards for older people at Pennine Care NHS Foundation Trust found a series of concerns including the use of the Mental Capacity Act. Inspectors found: ‘Where records of capacity assessments had been made,...some of these lacked detail and so it was not possible to see whether the requirements of the Mental Capacity Act had been complied with..’
‘...records of best interests' decision making were mostly either not available or insufficiently detailed to enable us to establish whether this process involved people and their relatives or carers where appropriate, and recognised the importance of the person’s wishes, feelings, culture and history.’
The inspection was triggered due to information received by the CQC from whistle blowing and complaints. Any professional or family member etc can contact the CQC with concerns about a care provider. As an inspectorate body it does not have to disclose who or where it receives information from (enquiries@cqc.org.uk).
