Contact between a married couple and the Mental Capacity Act

The Court of Protection has recently published an interesting (and sad) case about
a married couple in their 80’s, both with dementia and both in care homes. Initially they moved into a care home together but due to one of the partners challenging behaviour they had to be separated and eventually ended up living in separate care homes. The case considers attempts at difference types of contact (telephone – video – in person) and concludes with a ruling on what level of contact would be in their best interest in the future. The issue of couples where both partners have dementia is an increasing area in adult social care.
