CCTV in care homes and the Mental Capacity Act

The CQC is regularly looking at the use of CCTV in care homes and finding problems in terms of evidence of residents' consent or application of the Mental Capacity Act.  A recent inadequate rated inspection report (Wood Hill House) stated: ‘CCTV was in use in the building's common areas however, not all people had an active capacity assessment or best interest decision relating to the use of CCTV.’  Dowload the report from HERE.

A recommended guide to the use of CCTV in care homes is available from the British Institute of Human Rights HERE.
