Care Act - the duty to provide services


A recent Ombudsman report found a council was at fault because: ‘Although the Council assessed Mr D eligible for care services in July 2022 it did not provide support because of the lack of an available care agency. The Care Act says councils must meet eligible care needs. The failure to do so was not in line with the Care Act and is service failure.’ The council was ordered to pay the man concerned £500.
