About the Event

Aims

This half day course is designed to enable participants to feel equipped to attend the Court of Protection and to ensure they know what to expect including:

  • Refreshing key aspects of mental capacity law with reference to statute and code
  • Familiarise participants with the Court of Protection process, including during the Covid-19 pandemic
  • Key legal terms in the Court of Protection and what they mean
  • Assist participants with the process of evidence giving

Learning outcomes

By the end of the day, participants will have learned:

  • Increased knowledge of mental capacity law and practice
  • Increased knowledge of the statutory frameworks and rules within which the Court operates
  • Ability to identify where an application should be made
  • Improved understanding of the stages of a case in the Court of Protection

Programme

The day will include the following key topics:

  • Introduction and overview of the day
  • Introducing the Court of Protection
  • Key legal terms in the Court of Protection and what they mean
  • Courtroom etiquette
  • Giving evidence- tips on staying in control
  • Common errors that might be challenged through cross examination
  • Further discussion and questions, evaluations and close

The course will be delivered by Sophy Miles

Sophy is a barrister at Doughty Street Chambers where she specialises in Court of Protection cases, acting for vulnerable people, their families and local authorities. She is a fee paid (part time) judge of the First Tier Tribunal (Mental Health). She regularly writes, blogs and trains on mental health and mental capacity issues.

Sophy is co-author of two books

  • Court of Protection Handbook- Legal Action Group – 3rd edition
  • Mental Health Tribunals –Legal Action Group- 1st edition.
