Course - Transforming care : Community legal frameworks for people with learning disabilities and/or autism
Aims
The Transforming Care initiative in learning disability services means community services need to consider the most appropriate legal frameworks for individuals. This one day course aims to enable health and social services staff understand the different legal options for people with a learning disability. It includes the latest applicable case law in particular around CTOs and Conditional discharge. In particular, it considers the options available under the Mental Health Act, Mental Capacity Act and inherent jurisdiction looking at the criteria, powers and limitations of each.
Learning outcomes
On completion of this course participants will be able to:
- Understand the key legal routes for discharge into the community
- Explain how clients with different presentations and risks can be legally protected
- Demonstrate how different legal routes will affect their clients / service users
- Illustrate how they could use the various legal options available to them
Programme
The day will include the following key topics:
- Community legal options overview
- Community Treatment Orders – criteria + powers + limitations
- Guardianship – criteria + powers + limitations
- Deprivation of Liberty Safeguards (DoLS) – criteria + powers + limitations
- Community DoL via Court of Protection – criteria + powers + limitations
- Forensic Mental Health Act – conditional discharge + powers + limitations
- Inherent jurisdiction? If all else fails
- The ‘informal’ voluntary client – consent and the Mental Capacity Act
- Restraint – definition and criteria for use
- Identifying community care plans that are a deprivation of liberty
- Case studies – will look at different client profiles to identify the legal options available
- The future – Liberty Protection Safeguards and their role
The course will be delivered by Steven Richards
Steven is a Director of Edge Training and Consultancy and has worked in the mental health field for over 20 years, both for the NHS and voluntary sector. He has been an in-patient advocate for Mind and as an advocate Steven represented directly before the Court of Protection. Steven was a Mental Health Act Reviewer with the Care Quality Commission for over 10 years and also worked with the CQC as a specialist advisor on the Mental Capacity Act and DoLS. He delivers training on the Mental Capacity Act and Mental Health Act across England and Wales to health and social care professionals. Steven has experience of training a wide variety of services including local authorities, CCGs, NHS Trusts, the police, hospices and prison health services. He has spoken at a series of Health Education England conferences on the MCA at the end of life and delivered training on the draft Liberty Protection Safeguards bill to members of the House of Lords. Steven is co-author of 3 books:
