The Care Act after AGNI - 17 September 2026

Aims 

This one day course considers the impact of the Supreme Court (AGNI) ruling in relation to deprivation of liberty on the use and application of the Care Act.

Learning outcomes  

By the end of the course delegates will be able to:

• Describe the impacts of AGNI and consider implications from a human rights-based approach.

• Identify the safeguards available through the Care Act in the context of its general duties.

• Examine how to apply the Mental Capacity Act 2005 in the Care and Support Journey underpinning the Care Act 2014.

• Be more confident in applying the Acts in practice.

Programme

The course will include the following key topics:

• Legal hierarchy: legislation > statutory guidance > professional guidance

• Overview of the Care Act (CA) 2014 & Mental Capacity Act 2005 (MCA)

• Interface with Equality Act (2010) & Human Rights Act (1998).

• AGNI: What, Who, When, Why & Impacts 

• Rights overview: Care Act and DoLS

• The loss of paid Representatives and 39D IMCAs – compensating for this under the Care Act

• Safeguarding adults – impact and compensating for this under the Care Act

• BIAs- independent oversight and compensating for this under the Care Act

• Examination of duties/principles underpinning the Acts & how to apply in practice

• Promotion of wellbeing – participation & views and wishes.

• Advocacy – Care Act or Independent Mental Capacity Advocate?

• Consent for the Care Act v ‘Valid consent’ for deprivation of liberty

• How to assess – care and support needs, capacity & best interests

• Deprivation of liberty & authorisations to lawfully deprive a person of liberty.

The course will be delivered by Sara-Jayne Williams

Sara-Jayne Williams is a Social Work England registered social worker, having obtained her professional status in 2001. She has experience of working with older people, adults with learning disabilities and adults with physical health needs. Sara-Jayne has experience of front line social work practice, supervision and managing a social work team.

Sara-Jayne has a particular interest in the Mental Capacity Act (MCA) 2005 and Deprivation of Liberty Safeguards (DoLS). For eight years, she was employed as the lead MCA/DoLS professional for a local authority, advising social care staff on their use of the MCA and DoLS. She is a member of the National Mental Capacity Forum. Sara-Jayne is also a Best Interests Assessor (BIA) under DoLS. Sara-Jayne is passionate about demystifying the MCA. She is highly motivated, enthusiastic and driven to ensure best practice and compliance with human rights legislation.

Sara-Jayne was awarded a Post Graduate Certificate in Post-Compulsory Education in 2019. Sara-Jayne has designed, delivered and reviewed training on the MCA, DoLS and the Care Act 2014. Training has been delivered to a range of audiences, including health and social care, police, housing and colleagues from the private, voluntary and independent sector.
