About the Event

Aims:

This course aims to enable delegates to consider the impact of the Mental Capacity Act 2005 in relation to their role in safeguarding adults.

Learning outcomes:

· Improve knowledge and application of robust assessments of capacity in safeguarding adults cases

· Identify the legal aspects of the MCA that have particular importance in safeguarding and consider the role and use of the Court of Protection

· Consider how to use the MCA to respond to specific types of abuse and identify and carry out best practice in the application of the Mental Capacity Act

· The importance of the MCA in Safeguarding

· Safeguarding adults and the Mental Capacity Act – the power/authority to take action

· Learning from SAR’s LGA report Dec 2020

· Defining capacity and assessing capacity – fundamentals, case law and practical application in safeguarding cases

· Self-neglect and MCA

· Case Study Polly

Part 2

· MCA fundamentals

· Assessment of capacity and Best interests

· Taking risks - unwise decisions v lack of capacity

· Examples of action under the MCA and the Role of the Court of Protection

· Removal from home the right approach

· Interim orders and directions

· Inherent jurisdiction and safeguarding

The course will be delivered by Dawn Revell

Dawn is a qualified Social Worker having obtained her professional status over 18 years ago. She continues to practice as an Approved Mental Health Professional (AMHP) under the Mental Health Act 1983.She is a joint trained investigator for safeguarding adults and presently has responsibility for managing and advising on complex safeguarding adult cases.  Dawn presently manages a generic, county wide social services emergency duty team. She has worked as an associate trainer for over 4 years and has designed, facilitated and delivered training on risk assessment, mental health, mental capacity and safeguarding adults.
