Maintaining Human Rights in Care Homes during a Pandemic

Aims

This half day training course delivered by live interactive webinar will address some big human rights issues for professionals working in health and social care. DoLS teams and DoLS assessors in particular, may be interested in this course. In trying to deal with an emergency situation, it is sometimes difficult to ensure that human rights standards are maintained. Perhaps more than ever, it is important to scrutinise and reflect upon the impact of changes in practice on the most vulnerable.  In this training course, participants will be taken through the legal frameworks of Article 2, 3, 5 & 8 and the interface with their practice in light of the COVID-19 pandemic.

In particular, the course will consider the two judgments in the recent DoLS case of BP v Surrey County Council 2020, visiting care homes, access to video call facilities and the state’s responsibility to ensure that those in care homes are still protected by Article 2 ECHR (the right to life) and Article 3 ECHR (inhumane and degrading treatment).

Delivered by barrister and international human rights law expert, Dr Oliver Lewis. Oliver is a real champion for the human rights of those with disabilities. He worked for charities for 15 years in Budapest, before returning to the Bar of England and Wales.  While working for MDAC, one of Oliver’s most notable clients was Mr Stanev (Stanev v Bulgaria 2012). A case which has influenced much of our domestic case law and most notably, Supreme Court judgment in Cheshire West. The course will be delivered by Dr Oliver Lewis

Oliver Lewis is a barrister at Doughty Street Chambers where he practices in the Court of Protection and related public law matters with respect to people with disabilities or mental health issues. Before returning to the bar in 2017 he was executive director of Validity, an international human rights charity based in Budapest that advances the rights of people with mental; health issues or learning disabilities worldwide.

Oliver is also part-time Professor of Law and Social Justice at the School of Law, University of Leeds where he teaches on the LLB and LLM modules on disability law and leads the LLM module on global human rights advocacy and coordinates the international disability law clinic. He is a trustee of the Avon and Bristol Law Centre.

He has a law degree from LSE, an MA in Medical Ethics and Law from King’s College London and a PhD from the University of Leiden. Oliver has written extensively on international human rights law and disability, including a book published in 2007, “Mental Disability and the European Convention on Human Rights”.
