Executive functioning and the MCA - 5 March 2024

Aims

This course aims to enable front-line practitioners to develop a deeper understanding of this complex area through a review of relevant case law, knowledge across a broad range of presentations and situations, and group work to support practitioners to explore applying theory to practice.

Learning outcomes

By the end of the course participants will be able to:

· Consider the meaning and relevance of executive dysfunction on mental capacity and the assessment of mental capacity.

· Develop an understanding of recent key Court of Protection cases involving executive dysfunction.

· Consider complex cases from a different perspective to evaluate if another approach is warranted for the assessment of need and rise

- Examine how to record evidenced based assessments.

Programme

The course will include the following key topics:

· What is meant by executive function/dysfunction?

· Why look at executive functioning now?

· Causes and presentations of executive dysfunction.

· Detecting executive dysfunction – presentation, and patterns of referral

· Potential issues arising in assessing capacity with someone experiencing executive functioning difficulties, with a particular focus on using and weighing information.

· Nuances of presentation impacting on decision making.

· Practicable steps in supporting people to make their own decisions.

· Common problems arising in assessments.

· The relationship between executive functioning and fluctuating capacity.

· Supporting staff with assessing, evidencing, and recording.

· Key lessons from recent cases.

· How substance misuse can impact on executive functioning and decision making.

· Taking a different approach to identify need and risk in complex cases

The course will be delivered by Helen Kelsall

Helen is a qualified social worker, with many years experience working in mental health services, most recently as a Senior Practitioner in an assessment and treatment team carrying out Approved Mental Health Professional and Best Interests Assessor Work. She also has a counselling qualification and has a particular interest in the therapeutic side to social work practice. She now works as an Independent Social Worker.

More recently, Helen has been working in the homelessness mental health field - undertaking assessments with homeless people experiencing mental health problems and developing guidance and training in this field.  Helen has also previously provided clinical advice and support to a registered care home for people with mental health difficulties.
