DoLS after AGNI: a range of courses for your organisation

Following the Supreme Court's decision to overturn Cheshire West and the acid test, we have developed a range of courses to assist practitioners to understand and apply the new AGNI ruling in a variety of settings. These courses are designed to explain the new ruling in plain English, with analysis of practical examples, case law and case studies, in a way that will be useful for daily practice.


DoLS a New Era: A Half Day Briefing

This shortened version of our full day course provides social care practitioners with an update on the AGNI judgment, the key changes and what is staying the same.


DoLS a New Era for Social Care Practitioners

This full day course will explain the AGNI ruling in different settings, relevant to social care staff. It will consider deprivation of liberty in care homes, supported living and other community settings, including people living in their own homes.


DoLS a New Era for Care Homes

This half day course will explain the AGNI ruling in relation to care homes. It will assist care home managers and other staff to understand which residents need a DoLS application (Forms 1 and 2) and how to keep cases under review for those that no longer need the Safeguards. The course will also consider questions the CQC might ask about how care homes have applied AGNI and the care home's system of reviewing those cases


DoLS a New Era for Hospitals

This half day course explains the application of the new legal approach in different hospital settings. It addresses the 'exceptions' to Article 5 ECHR and how these will apply in hospital settings.


DoLS a New Era for BIAs

This detailed analysis for BIAs will go into the subjective and objective elements and how the Supreme Court has interpreted them in 2026. The course will explain the direct impact on BIA practice and how to ensure the new detailed multi-factorial analysis is captured on Form 3 or Form 3A.


DoLS a New Era for BIAs- Back to Basics and Report Writing (two days)

The AGNI judgment means more detailed recording than before, due to the changes in the way the subjective and objective elements are being interpreted. This two day course is ideal for out of practice BIAs, looking for an in depth analysis of the AGNI judgment plus step by step guidance on record keeping on the full DoLS Form 3A or 3, looking at the mental capacity assessment, no refusals, best interests, conditions, recommendations and legally compliant relevant person's representative (RPR) selection and recommendation.


DoLS and the Mental Health Act Interface after AGNI

The AGNI judgment means a new approach to detention under the Mental Health Act and a fall in DoLS cases in mental health wards. This course will focus on a variety of examples such as delirium, Mental Health Act use in acute wards and emergency departments. It will also look at what will stay the same, in the context of the Eligibility assessment.


The Care Act after AGNI

The AGNI ruling means the likely loss of safeguards for over 100,000 people. Whilst the Care Act doesn't contain the same safeguards and the application of those safeguards is limited, in comparison, practitioners should ensure that any Care Act safeguards are being fully utilised and people lacking mental capacity about their care arrangements and their families, are kept fully informed of the availability of these safeguards.


Deprivation of Liberty (DoL) in the Community after AGNI

This one day course will assist practitioners to understand the new approach in the community setting. It will explain how to review cases and where necessary, apply to the Court of Protection with the evidence of a case no longer being a deprivation of liberty. It will also consider how to record this evidence on the necessary court forms.


AGNI for AMHPs: AGNI content has been integrated into the one day legal updates for AMHPs.
