The failure to assess mental capacity

On 1st November a coroner identified the failure to assess mental capacity as an issue of concern in the death of Neil Bastock who died aged 57. Neil was an inpatient on a mental health ward at the time of his death. In relation to his discharge from Section 3 and his absence from the ward the coroner found: ‘no formalised assessment of his mental capacity was made prior to the decisions.’
